Having been grilled by Democratic lawmakers over her recollections of a White House meeting in which President Trump described some poor nations sending immigrants to the United States as "shithole countries," Department of Homeland Security Secretary Kirstjen Nielsen dropped a potentially even bigger tape-bomb.
The Hill reports that Nielsen testified she did not recall Trump saying “shithole countries” while she spoke under oath before the Senate Judiciary Committee. She described the meeting as heated and said many people in the room used coarse language.

But then Nielsen shocked more than a few Democratic leaders across the nation, who appear to have grown accustomed to living beyond the law.

According to The Washington Times, Nielsen confirmed Tuesday that her department has asked federal prosecutors to see if they can lodge criminal charges against sanctuary cities that refuse to cooperate with federal deportation efforts.

U.S. Immigration and Customs Enforcement Director Tom Homan says those policies put his officers and local communities at more risk because they have to arrest illegal immigrants out in the community.
Mr. Homan told The Washington Times last July that he wanted to see local officials charged as complicit in human smuggling if they shielded illegal immigrants through sanctuary policies. Mr. Homan repeated that demand in an interview with Fox News earlier this year, setting off a firestorm of criticism.[/size]

Hidden beneath the controversy stirred up last week by the publication of a book called “Fire and Fury,” a highly critical insider’s view of the Trump White House that the president has not only denounced on national television but also tried to prevent from being published and distributed, are the efforts of the Trump administration and congressional leadership to bypass the Fourth Amendment to the Constitution.
Here is the back story.
After the excesses of the Watergate era, during which the Nixon administration used the FBI and the CIA unlawfully to spy without warrants on the president’s real and imagined domestic political opponents, Congress passed the Foreign Intelligence Surveillance Act.
FISA prohibited all domestic surveillance except that which is pursuant to warrants signed by federal judges.
The Fourth Amendment - which guarantees privacy in our persons, houses, papers and effects - permits the government to invade that privacy only when a judge has signed a warrant that authorizes surveillance, a search or a seizure. And judges may only issue warrants when they have found probable cause to believe that the government surveillance or invasion of the target’s privacy will produce evidence of criminal behavior. The Fourth Amendment further requires that the judicial warrant describe specifically the place to be searched or the person or thing to be seized.
All these requirements are in the amendment so as to prevent any court from issuing general warrants. Before the Constitution, general warrants were issued by British courts that met in secret in London. They were not issued based on probable cause of crime but issued based on the government’s wish to invade the privacy of all Americans living in the Colonies to find the more rebellious among them. This was the king and Parliament’s version of protecting national security.
General warrants did not describe the place to be searched or the person or thing to be seized. They authorized the bearer — usually a British soldier physically located in the Colonies — to search where he wished and seize whatever he found.
FISA did not interfere with the standard understanding or use of the Fourth Amendment by the government and the courts. But it did add another way for the government to invade privacy when its wish is to surveil people for national security purposes - a return to general warrants - as opposed to solely gathering evidence of crimes.
The FISA-created procedure, enacted in defiance of the Fourth Amendment - which makes no distinction between government evidence gathering and government intelligence gathering - permits a secret court in Washington to issue general warrants based on the government’s need to gather intelligence about national security from foreigners among us. It pretends that the standard is probable cause of foreign agency, but this has now morphed into the issuance of general warrants whenever the government wants them.
Since 1977, the Foreign Intelligence Surveillance Court has issued well over 99 percent of the warrants that the government has requested. And these warrants do not specifically describe the place to be searched or the person or thing to be seized. A typical FISC-issued warrant authorizes government surveillance on all landlines, mobile devices and desktop computers in a given area or ZIP code. One infamous FISC-issued search warrant permitted the feds to surveil all Verizon customers in the U.S. — in excess of 115 million people — without any evidence of crime or even suspicion about any of them.
Now back to the Trump administration’s work below the radar. Even in the fresh aftermath of 9/11, when the government’s respect for constitutional norms was at a lamentably low point, the government interpreted the Fourth Amendment as requiring the government to separate its intelligence functions from its law enforcement work. The government recognized that its trigger for mass surveillance - namely, looking for a foreign agent among the populace - was a far lower standard than probable cause of crime, which is what the Fourth Amendment requires.
Today, the federal government’s computers are permanently connected to the mainframes of all telecoms and computer service providers in America, so the spying is in real time. Today, the federal government employs more than 60,000 domestic spies — one spy for every 5,500 Americans. Today, if any of them come across evidence of crimes while listening to your telephone calls or reading your texts or emails ostensibly for intelligence purposes, there is little they can do about it.
Until now.
Now, hidden beneath the “Fire and Fury” controversy is the muffled sound of the Trump administration and Republican congressional leaders plotting the enactment of an addition to FISA that would permit the use of evidence of crimes in federal court even when it is discovered during mass surveillance authorized by general warrants.
If enacted, this radical, unconstitutional hole in the Fourth Amendment would bring the country full circle back to the government’s use of general warrants to harass and prosecute - general warrants so odious to our forebears that they took up arms against the king’s soldiers to be rid of them.
I am surprised that President Donald Trump supports this. He has himself been the target of unlawful foreign surveillance and unconstitutional FISC-authorized domestic surveillance. “Fire and Fury” even quotes former British Prime Minister Tony Blair warning a newly elected Trump about this. And now he wants to unleash upon us all the voracious appetite for surveillance that was unleashed upon him and prosecute us for what is found, the Constitution be damned.
Whatever happened to the public promise to preserve, protect and defend the Constitution as it is written? That’s in the oath all in government have taken. That is the oath that the president and his Republican allies reject.

SACRAMENTO (CBS13) — With the reading of their own version of a Declaration of Independence, founders of the state of New California took the first steps to what they hope will eventually lead to statehood.
To be clear, they don’t want to leave the United States, just California.
“Well, it’s been ungovernable for a long time. High taxes, education, you name it, and we’re rated around 48th or 50th from a business climate and standpoint in California,” said founder Robert Paul Preston.
The state of New California would incorporate most of the state’s rural counties, leaving the urban coastal counties to the current state of California.
“There’s something wrong when you have a rural county such as this one, and you go down to Orange County which is mostly urban, and it has the same set of problems, and it happens because of how the state is being governed and taxed,” Preston said.
But unlike other separation movements in the past the state of New California wants to do things by the book, citing Article 4, Section 3 of the US Constitution and working with the state legislature to get it done, similar to the way West Virginia was formed.
“Yes. We have to demonstrate that we can govern ourselves before we are allowed to govern,” said founder Tom Reed.
And despite obstacles, doubters, and obvious long odds the group stands united in their statehood dream.
The group is organized with committees and a council of county representatives, but say it will take 10 to 18 months before they are ready to fully engage with the state legislature.

Turkey is poised for an imminent massive ground invasion of Northern Syria to quash Kurdish militia groups currently holding Afrin near the Turkish border. Multiple regional outlets have reported a build-up of forces that could constitute the largest external intervening force thus far in the entirety of the Syrian war.

According to Middle East based Al-Sura News, Turkey's military build-up currently underway includes special forces troops, Army units, Turkish-backed Syrian Rebels and Turkey's air force. The Kurdish YPG/J (People's Protection Units) has held Afrin since the Syrian government withdrew from the area in 2012, which constitutes the western-most part of the self-declared Rojava autonomous Kurdish zone.

Turkey considers it a "terrorist" enclave as it sees Syrian Kurdish factions as an extension of the PKK, while the US has claimed not to be active in supporting Kurdish operations in Afrin, which lies a mere 40 kilometers from Aleppo where the Syrian Army continues to advance through the Aleppo countryside and into Idlib province.

Over the weekend President Recep Tayyip Erdogan slammed recent US efforts to ramp up support for the Kurdish dominated Syrian Democratic Forces (SDF), saying during a speech in Ankara, “A country we call an ally is insisting on forming a terror army on our borders." He framed US support to Syrian Kurds as undermining Turkey's security, adding, “What can that terror army target but Turkey? Our mission is to strangle it before it’s even born."

Meanwhile a top Turkish general told a meeting of NATO military commanders, "We cannot and will not allow support and arming of the YPG terror group under the name of an operational partner. We hope this mistake will be corrected in the shortest time."

Regional outlets Al Jazeera and Al Masdar News have confirmed that the large Turkish convoy has entered northwest Syria and that sporadic fighting against Kurdish forces is already underway. Notably the air force is said to be mobilized - a significant factor as Turkish ground forces, including its proxy rebel forces making up its "Euphrates Shield Operation", have had little success in the past dislodging Kurdish fighters without air support.

Should aerial power be utilized by Turkey it would mark a dramatic escalation, especially given that both Russia and the US operate over Northern Syria, with Russia controlling the airspace over Afrin Canton (as well as over Idlib, which have generally frustrated Turkish plans for greater involvement). Whether the operation against Syrian Kurds moves forward or not into a full scale Turkish assault depends in large part on Russia, which has administered 'deconfliction' zones in the Afrin area, and has sponsored trilateral talks with Turkey and Iran which seeks cooperation among the three powers to wind down the war in Syria. 

In response to news of the impending Turkish invasion, US Coalition spokesman Col. saidTuesday of the Syrian Kurds in Afrin, "We don't support them, we have nothing to do with them." Dillon explained further when pressed by Turkish state media journalists, "We are not operating in Afrin. We are supporting our partners in defeating remaining ISIS [Daesh] pockets along the Middle Euphrates River Valley, specifically in areas north of Abu Kamal, on the eastern side of the Euphrates River."

Turkey's current build-up and offensive comes after Dillon's controversial comments on Sunday in which he announced that the US coalition will establish a 30,000-strong new border security force with the SDF in Syria. In claiming to have "nothing to do with" Syrian Kurds operating in Afrin the Pentagon is seeking to distance itself from entering into direct conflict with Turkey in northwest Syria. 

Though Turkey has threatened many times before that it will dislodge Afrin from control of the Syrian Kurds, Erdogan might not be bluffing this time. Late on Tuesday he's reported to have phoned NATO General Secretary Jens Stoltenberg in order to inform NATO that the Afrin operation is being launched. [/size]

Nuclear-capable B-52 bombers join B-2s, B-1Bs on Guam amid tensions with North Korea

The U.S. Air Force announced Tuesday that it has deployed six of its powerful B-52 strategic bombers to Guam amid tensions with nuclear-armed North Korea.
The six planes, accompanied by 300 airmen, join three of the air force’s B-2 stealth bombers that were also recently dispatched to the U.S. island territory, home to Andersen Air Force Base, a key American outpost in the Pacific.


The base is also currently hosting several B-1B heavy bombers. While both the B-52 and B-2 are capable of carrying nuclear payloads, the B-1B has been modified to carry conventional ordinance only.
The deployment, conducted “in support of U.S. Pacific Command’s (PACOM) Continuous Bomber Presence mission,” according to a U.S. Pacific Air Forces statement, is likely to raise eyebrows in North Korea, which last year threatened to fire missiles near Guam.
The B-52s were last deployed to the region in July 2016, during which they conducted a variety of joint and bilateral training missions with the U.S. Navy, U.S. Marine Corps, Air Self-Defense Force, South Korean Air Force and Royal Australian Air Force.
The move, widely seen as a show of American military muscle, was likely intended to reassure Asian allies nervous amid the North Korean nuclear crisis.
“The B-52Hs return to the Pacific will provide U.S. PACOM and its regional allies and partners with a credible, strategic power projection platform, while bringing years of repeated operational experience,” the U.S. Pacific Air Forces said in its statement.
“This forward deployed presence demonstrates the U.S. continued commitment to allies and partners in the Indo-Pacific region,” it added.
It was unclear how long the base, some 3,400 km from North Korea, would play host to all three bombers.
Overflights of the Korean Peninsula by heavy bombers such as the B-52, B-2 and B-1B have incensed Pyongyang. The North sees the flights by what it calls “the air pirates of Guam” as a rehearsal for striking its leadership and has routinely lambasted them as “nuclear bomb-dropping drills.”
In November, the U.S. Pacific Air Forces confirmed to The Japan Times that it had flown two B-52s for a rare joint mission with the ASDF in the skies near North Korea in August.
The North has ramped up its threats to the U.S. and its allies in recent months in both words and deeds — including with successful tests of what the country claimed was a powerful hydrogen bomb and the separate test of an intercontinental ballistic missile believed capable of striking the American mainland.
