(AP) — U.S. Attorney General Jeff Sessions is taking the fight over the nation’s immigration policy directly to California by suing to block state laws that extend protections to people living in the U.S. illegally. He was expected to speak to law enforcement officials in the state’s capital Wednesday, just hours after the U.S. Justice Department filed suit — the most aggressive move yet in the Trump administration’s push to force so-called sanctuary cities and states to cooperate with immigration authorities. The U.S. Justice Department is challenging three California laws that, among other things, bar police from asking people about their citizenship status or participating in federal immigration enforcement activities. The suit filed in federal court in Sacramento says the laws are unconstitutional and have kept federal agents from doing their jobs. “The Department of Justice and the Trump administration are going to fight these unjust, unfair and unconstitutional policies that have been imposed on you,” Sessions said in prepared remarks. “I believe that we are going to win.” California officials remained defiant, with Democratic Gov. Jerry Brown mimicking President Trump on Twitter as he criticized Sessions for coming to Sacramento “to further divide and polarize America. Jeff, these political stunts may be the norm in Washington, but they don’t work here. SAD!!!” Brown is named in the lawsuit along with Democratic Attorney General Xavier Becerra, who said the state is on firm legal footing. “Our track record so far when it comes to any dispute with the federal government has been pretty good,” Becerra said. The lawsuit is the latest salvo in an escalating feud between the Trump administration and California, which has resisted the president on issues from taxes to marijuana policy and defiantly refuses to help federal agents detain and deport immigrants. U.S. Immigration and Customs Enforcement has said it will increase its presence in California, and Sessions wants to cut off funding to jurisdictions that won’t cooperate. “I say: Bring it on,” said California Senate President Pro Tem Kevin de Leon, a Los Angeles Democrat who wrote the so-called sanctuary state bill. Democratic Assembly Speaker Assembly Speaker Anthony Rendon was among those suggesting that Sessions shouldn’t come at all. The lawsuit was filed as the Justice Department also reviews Oakland Mayor Libby Schaaf’s decision to warn of an immigration sweep in advance, which ICE said allowed hundreds of immigrants to elude detention. Schaaf said Tuesday the city would “continue to inform all residents about their constitutional rights.” The California laws were passed in response to Trump’s promises to sharply ramp up the deportation of people living in the U.S. illegally. One prohibits employers from letting immigration agents enter worksites or view employee files without a subpoena or warrant, an effort to prevent workplace raids. Another stops local governments from contracting with for-profit companies and ICE to hold immigrants. Justice Department officials said that violates the Constitution’s supremacy clause, which renders invalid state laws that conflict with federal ones. The Supreme Court reinforced the federal government’s primacy in enforcing immigration law when it blocked much of Arizona’s tough 2010 immigration law on similar grounds. The high court found several key provisions undermined federal immigration law, though it upheld a provision requiring officers, while enforcing other laws, to question the immigration status of people suspected of being in the country illegally. In this case, California “has chosen to purposefully contradict the will and responsibility of Congress to protect our homeland,” Homeland Security Secretary Kirstjen Nielsen said in a statement. Sessions, who has blamed sanctuary city policies for crime and gang violence, was to speak Wednesday to groups representing police chiefs, sheriffs, district attorneys, narcotics investigators and the California Highway Patrol. Only the California State Sheriffs’ Association actively opposed the so-called sanctuary law. On Wednesday morning, dozens of demonstrators chanted “stand up, fight back” and “no justice, no peace” outside the hotel where the meeting was being held and some blocked traffic on a major thoroughfare. A heavy police presence was on hand. Demonstrator Henry Gordon of Sacramento said he hopes Sessions gets the message that Californians will resist efforts to separate families and deport immigrants. As we see from MrMBB333 in the 1st video below, something incredibly strange is going on in the Gulf of Mexico with air temperatures recorded at over 130 degrees over and over again the past week, with temperatures fluctuating between 'normal' temperatures in the 75 to 80 degrees range before suddenly shooting up to at least 133 degrees as we see in videos and the 2nd image below. gom_hot_spot.png What might be causing the huge temperature fluctuations in the Gulf of Mexico we're witnessing in the screenshot above from the 2nd video below from videographer rushfan9thcmd, who has been keeping track of this very strange anomaly now for over a week? As we see in the next screenshot below of that same area which we've turned into a gif photo, the high temperature spot is fluctuating, as if it is the Earth itself breathing, spiking to up over 133 degrees before falling back to 'normal' levels then spiking once again. SOURCE: MATT AGORIST The cops were the intruders. They were there to ostensibly check on the wellbeing of the couple and ended up killing an innocent man.
Saratoga, CA — Last year, the widow of an 86-year-old Navy veteran who was gunned down by armed intruders in his own home, filed a lawsuit against her husband’s killers — the Santa Clara County sheriff’s department. Now, the person who murdered this innocent man will not be held accountable as the killing of Eugene Craig has been ruled justified by the Santa Clara County district attorney’s office.
Craig was gunned down by police as he attempted to shield his wife from armed intruders who’d just broken into his home. The armed intruders were cops.
On Sept. 12, 2016, according to Harue Craig’s attorneys, prior to the shooting, deputies kicked down two doors before opening fire inside the Craigs’ Saratoga home on Titus Avenue.
As KTVU reported at the time, attorneys said their client stated that both she and her late husband were “very scared” and did not know why their doors were being kicked down.
The elderly couple thought they were victims of a home invasion, so Eugene grabbed his .38 caliber revolver and bravely stood in front of his wife as they listened to the intruders come into their home.
When the intruders opened the bedroom door, they saw the elderly vet standing there with the revolver and one deputy opened fire. Although there were multiple deputies in the home, deputy Doug Ulrich was the only one who felt the need to begin shooting.
Eugene died on the scene.
According to police, they were at the home to conduct a welfare check. Craig’s granddaughter called police the night of the shooting because she hadn’t heard from her grandparents in a week, according to prosecutors.
The sheriff’s office said that deputies clearly identified themselves, called the home phone, and tapped on windows repeatedly before entering.
In spite of their alleged efforts to identify themselves, the couple still didn’t believe them. After all, they were both entirely innocent and cops coming into their home was a far-fetched idea. Any home invader could simply claim they’re the police to easily gain entry into someone’s home.
The tragic irony of this situation is that police claim they were there to protect the couple, noting that they had gotten word that someone inside the home was in distress. Sadly, this is what happens when militarized police are sent into an innocent couple’s home to check on their well-being.
Naturally, after they killed the innocent man — while ‘protecting’ him — police immediately attempted to justify their actions and as this ruling by the DA illustrates, it worked.
“The law allows Deputy (Douglas) Ulrich to fire his weapon in defense of others (and himself) until Craig no longer posed an imminent threat,” wrote Stacey Capps, a supervisor in the district attorney’s homicide unit. “In short, Deputy Ulrich genuinely believed that Craig presented an imminent threat of death or great bodily injury to others or himself when he discharged his duty weapon.”
However, the only ones who created the threat of imminent danger were the police. Craig had harmed no one.
As NBC Bay Area reported at the time, the attorney for Craig’s 90-year-old widow, Dennis Luca, a long-time retired San Jose Police officer, turned civil attorney, was originally hired by Craig’s 90-year-old widow after the shooting last fall.
“Simply put, they did not follow established policy and procedure that virtually all police departments, sheriff’s office follow regarding the escalation of force,” said Luca.
“If you’re there at someone’s house to check on their welfare, why do you kick two doors down at night time when my client is 86 years old, his wife is 90, and they live alone at that house and they have for years?” asked Luca.
“They (deputies) didn’t progress through the steps necessary, and that’s why I say they created the deadly force event. Not Mr. Craig, who has a right to be in his house. He hadn’t committed a crime,” said attorney Luca. “He has a right to be safe in his house like all of us do. The police just can’t kick doors, come into the house and start shooting.”
Welfare checks, as they are known in the United States, are crap shoots that have the potential to explode into violence at any moment. The Free Thought Project has reported on numerous instances in which police have shown up to ‘protect’ someone who may be suicidal or in distress only to end up hurting or killing them.
Sadly, Craig is now one of these statistics and the people who did it to him will not be held responsible for taking an innocent man’s life.
Nothing will bring back Harue Craig’s beloved husband. However, her lawsuit will serve as yet another reminder of the effect of police violence on situations that require no force at all. When law enforcement’s only tool is a hammer — everything begins to look like a nail.
“It didn’t have to happen. It shouldn’t have happened,” said Luca. “And now I have a 90-year-old woman who is alone, who was married for many years to a war veteran, a pilot, and now she has no one. That’s not a tragedy. That is horrific.”
