The Kraken is the name of the DOD cyberwarfare program,  which Ezra heads. 
No one could do that type of analysis on an on going, high alert basis and also
be the public face of the operation, OR deal with the demands of DOD oversight.
So there is a group.   Originally we were told 3 civilians and 7 military.  And us-the digital army. 

I would guess that Sidney did not say "Release the Kraken" till there was confirmation Special Forces had possession of the servers in Frankfurt.  

Just because all the necessary information was known beforehand, there's that tricky thing about evidence in a court of law.
